My Lords admit that, under the circumstances, this is a case in which the Government may be a party to the payment of its servant for performing duties other than those for which they are employed.
My Lords are, however, clearly of opinion that whatever payment may be made to Dr. Buchanan, with their assent, is a part of the cost of executing the Hospital.
There is no greater reason for charging it to imperial funds than the payments to the Architect for preparing the plans, or to the contractor for executing them.
If Lord Kimberley has any doubt whether this expense is covered by the request of the Colonial Government to his Lordship to take steps for procuring designs for the Hospital on the most approved principles of Modern construction, My Lords can only suggest that further Authority should be obtained, or, at any rate, that Dr. Buchanan should be informed that, if the Colony repudiates the charge, he certainly
